President Trump’s attorneys had opened an article 78 proceeding accusing the judge of acting unlawfully, and asked for a writ of prohibition.
‘He must stand trial in a courtroom under the same procedures that govern all other criminal defendants,’ a judge wrote for the panel.
Judges asked attorneys to balance their cases against the First Amendment and the need to protect trial proceedings.
‘Considering the constitutional and statutory rights at issue an interim stay is granted,’ the judge wrote.
