Siyamak sits down with Jonathan Madison, a real estate attorney who represents both landlords and tenants in eviction cases in Oakland and the rest of the Bay Area. He talks about his experiences dealing with the lasting impacts of eviction moratoriums and the changes to rental laws in California. We also had a chance to talk to Stephanie Warren, who’s a small housing provider in Oakland. She shares the story of how people broke into her home and refused to leave.

“The goal was to keep tenants in their homes, and it just sounds great. The problem is people breaking and entering and just squatting. The law says I can go into someone else’s property and call it my own. I'll just stay there and wait until I get evicted.”

Join us as we delve into the unintended consequences of the eviction moratorium in Oakland, such as landlords facing financial hardships and foreclosures due to non-payment of rent, while tenants are taking advantage of legal loopholes, engaging in actions that make it difficult for landlords to regain control of their properties.

We also discuss the struggles of small landlords, many of whom are immigrants and minorities, facing the prospect of losing their properties. Mr. Madison expresses concerns about the impact of property transfers to large corporations or nonprofits, leading to a loss of property for small landlords and shares insights into the mindset of tenant advocacy groups, suggesting that some may genuinely believe in housing as a human right, leading them to defend tenants even in cases where they may be unlawfully occupying properties.
