WAWAYANDA, N.Y.—A Middletown man is in critical condition after being shot by an off-duty Kingston police officer during an apparent road rage incident, New York State Police say.

Officers from the New York State Police Middletown barracks responded to the Dec. 11 shooting at about 3:45 p.m. on Dolsontown Road near the intersection with McVeigh Road.

According to a state police report, the altercation between the off-duty officer, identified as Anthony Simon, 33, and Middletown resident Wallace Fisher, 31, lasted for about a mile along Dolsontown Road. Fisher left his 2020 Volkswagen and approached Simon’s 2021 Toyota pickup truck, and a verbal exchange ensued through the driver’s window before turning physical, according to the police report.

Authorities said Simon drew his firearm and shot Fisher after the latter allegedly attacked him with a knife. Fisher is in critical but stable condition at Westchester Medical Center in Valhalla.

An eyewitness in a car behind the two vehicles took a one-minute video of the incident, which was posted to social media. The video appears to show Fisher passing and cutting off Simon’s truck before stopping in the road. Fisher gets out of the driver’s seat of his car and approaches the open window of the truck’s driver’s side.

In the video, Fisher can be heard shouting and pointing to other cars. The truck driver’s voice is not heard. As the confrontation intensifies, Fisher appears to punch into the car. Three shots can then be heard, and Fisher falls to the ground. The video is too blurry to show whether Fisher was holding a knife as mentioned in the police report.

Simon then exits his truck with his firearm trained on Fisher, and the video ends.

The state police told The Epoch Times that as of Dec. 15, there is no more information about the case available to the public. The Orange County Sheriff’s Office did not respond to a request for comment.

The state police had help from the City of Middletown Police Department, Orange County Sheriff’s Office, Greenville Township Volunteer Ambulance, and Wawayanda EMS during the incident.
