Federal Court Affirms HHS Authority to Deny Convicted Physician’s Access to Federal Health Care Programs

HHS is authorized to exclude entities from federal health programs under Title 42 of the U.S. Code.

A federal court in New York on Sept. 17 affirmed the decision by the Department of Health and Human Services (HHS) to deny a Manhattan physician’s access to federal health care programs for 11 years.

Plaintiff Asim Hameedi pleaded guilty to conspiracy to commit health care fraud in February 2018, the court order states.
