In their second day of deliberations, the jury in the trial of Police Officer Richard Kern hit a snag when false information about Kern’s past was circulated, leaving the jury itself open to possible allegations of pollution.

Information was circulated that Kern was previously involved in violence, though the judge pointed out that such information was “not correct,” according to New York Times report.

Kern is being accused by Michael Mineo of sodomizing him with his baton. Two other police officers are being accused of covering up the alleged assault by Mineo, who has a criminal history that includes the night in question and is suing the city for $440 million.
