A Nashville man has been charged with child neglect after allegedly kicking his five-year-old son outside of the house.

His son had blankets, shoes, and pants, but didn’t have a t-shirt on.

Jose Rivera Jr., 34, is being held in custody, with bail set at $10,000, the Tennessean reports.

A passerby has alerted the police after seeing the shirtless child wandering in the streets near Rivera’s home. She told the police that the boy didn’t know where he was, and that he had been kicked out of his home by his father.

The boy was crying and appeared to be scared when talking to the police, the warrant said.

The police proceeded to Rivera’s home and knocked on his door, asking him where his son was. Rivera said his son was on the couch watching TV, then changed the story to say that he was sleeping.

After Rivera’s arrest, custody of the boy was given to the mother.
