A U.S. Marine sergeant based in Southern California said that he faces dismissal and demotion for comments that he said on his Facebook page about President Barack Obama, according to reports.

Gary Stein, 26, said the allegations have been “drummed up against me,” reported the Los Angeles Times. He said that he always stayed within the guidelines stated by the Defense Department and had never “spoken on behalf of the Marine Corps or in uniform.”

Stein posted his comment on a Facebook page called the Armed Forces Tea Party.

“It means that military do not rate the same basic rights that all other Americans do. I don’t remember reading that in the Constitution,” one of his posts said, according to NBC.

However, the Marines said they investigated him for saying that he wouldn’t follow what he described as illegal orders from the president, including killing Americans or taking away their weapons.
