Former state Sen. Hiram Monserrate’s appeal to temporarily block his expulsion was shot down by Judge William Perry on Friday.

Monserrate was voted out of office by other state senators earlier this month, stemming from him assaulting his girlfriend. He was convicted of a Class A misdemeanor. The Judge said that the Senate has the right to expel Monserrate.

Several days after being ejected from the Senate, Monserrate filed a lawsuit, saying that his voters were hurt in the decision because they didn’t have any say in his expulsion.

A special election to fill Monserrate’s seat will be held on March 16.

The state attorney general’s office issued a statement on Friday in support of the decision: “Today’s ruling is a step in that direction. The office of the attorney general will continue to represent the Senate in this matter.”
