Exiled Chinese Law Professor Talks about Luo Gan – The Man behind Massacres and Persecution

Overseas media have singled out Luo Gan as the person responsible for the Shanwei killings on December 6, 2005 and the recent attempted assassination of the renowned human rights attorney Gao Zhisheng, in China. Luo Gan is the Director of the Politics and Law Committee of the Chinese Communist Party (CCP). He is in charge of the communist regime's Ministry of Public Security, the courts, and the Ministry of Justice. According to Professor Yuan Hongbing, a renowned scholar and jurist now in exile from China, "Luo is a cruel and crazy person."

Professor Yuan practiced law in China for many years. In an interview with the Sound of Hope Radio Network, he stated that he and his colleagues have three general views of Luo.

The first is that Luo does not understand law at all. One court chief, who met Luo in person, stated in public that Luo's legal knowledge is less than he had when he was a sophomore in college. If that is the case, then a person who does not know the law has taken control of the legal system in China.

Another view is that Luo is an extremely cruel person. When he was inspecting detention centers in Hebei Province, he heard the anguished cry of a prisoner who was suffering the torment of more than three months of solitary confinement. Upon hearing the terrible wail, Luo responded with an expression of indifference. People who accompanied him on the tour later commented that he was a cruel and merciless person.

The third view is that Luo is an opportunist. A person who works in one of the central departments of the CCP said that Luo's employees have commented that Luo can change facial expressions in an instant. On one occasion, when he was facing Jiang Zemin, he smiled radiantly, but as soon as he turned around, his face immediately became gloomy.

Professor Yuan analyzed the reasons why Luo could take charge of the judiciary and public security systems in China. Despotic politics are absurd. Despots grant power according to loyalty to the dictator, not according to abilities or morality. Thus, Luo was promoted quickly in the time of Li Peng because he was loyal to Li.

Later, when Li lost power to Jiang Zemin, Luo followed Jiang. Though Jiang is no longer in power, he still has great influence. Jiang chose Luo because Luo does not understand law and because Luo is loyal to him.

Why give Luo so much power? According to insiders, Jiang is most fearful of lawsuits filed by Falun Gong practitioners, and he is anxious to solve what he calls the "the Falun Gong problem." He is afraid that if someone else were to take charge of the judicial systems and law enforcement in China, the person might not deal with Falun Gong according to Jiang's wishes. Jiang has to have a loyal servant like Luo in charge of the judiciary and law enforcement in China.

Professor Yuan thinks that it is the basic reason that Luo, who does not know law at all, can hold power over the legal system in China. According to Professor Yuan, Luo is the driving force behind the corruption and cruelty of China's police, courts, and procurator systems.

The three systems in China—law enforcement, the procurator, and the court system—are all organized and managed under the Politics and Law Committee, and Luo Gan is the one at the top. In China, the courts and the police are the most corrupt systems. Under Luo's management, corruption is worsening.

Taking the court system as an example, Professor Yuan said that a large number of cases of injustice in China were created by the courts themselves. The courts do not rely on law to make their decisions. Moreover, the courts, which have become self-regulated, are avenues for judges to grab wealth. That is the reason why there are so many people making appeals in China. The purpose of most of the appeals is to correct the wrong decisions made by the courts.

Because the law enforcement system has even less restriction and supervision than the court system, it is even more corrupt. Without proper oversight, the system is not only corrupt, but it is also very cruel. Although the law states that the procurator has the right to supervise the police, in reality, this kind of supervision is impossible to execute. There is a saying circulating around China's legal system: "The Police are number one; the courts are number two; and the Procurator is number three." It means law enforcement is the biggest and most powerful system, followed by the court system, and then the procurator. Luo Gan is the man responsible for the corruption and cruelty of the whole system.

Under the leadership of China's former General Secretary Hu Yaobang and former Chinese Premier Zhao Ziyang in the 1980s, there was great interest in abandoning the Politics and Law Committee systems and having the police, the courts, and the Procurator operate under legal regulation. But after the Tiananmen Square massacre and especially after the beginning of the persecution of Falun Gong, all three systems have fallen under the leadership of the Politics and Law Committee.

Luo Gan gave his full support to the persecution of Falun Gong that was launched by Jiang Zemin. As the Secretary of the Politics and Law Committee, Luo has full responsibility for the corruption of the court system and the brutal acts that police have committed during the suppression of people's activities for human rights. Professor Yuan also pointed out that Luo must be held accountable for the Tiananmen Square massacre and the persecution of Falun Gong practitioners.

He said that Luo Gan is the kind of person who is extremely fearful despite the fact that he has control of a nation's power. Luo should know clearly that history will make him pay for the two most terrible crimes he has committed: The first is his complicity in the Tiananmen Square massacre. The second is his conspiracy in the persecution of Falun Gong. If Jiang Zemin is the No.1 criminal, Luo is No. 2. He surely knows the crimes he has committed. Perhaps he did not expect that the people would follow his trail so closely. Falun Gong practitioners' persistent legal activities around the world especially give Luo reason for fear. Filled with fear, he has become even more crazed.

The latest example is the assassination attempt on attorney Gao Zhisheng, who has published several open letters appealing for Falun Gong practitioners. There is a Chinese saying that if heaven wants someone to die, the first thing is to let him become crazy. Luo Gan is surely close to his end.
