Jodi Arias Trial: New Jury Will Have Tough Time Deciding Sentence


The sentencing phase of the Jodi Arias trial is set to start in March, but the new jury will have a hard time deciding whether to sentence Arias to life in jail or death.

Marilou Allen-Coogan was part of the first jury, which couldn’t make a unanimous decision, forcing this next phase.

She told CBS that the new jury may not be able to choose the death sentence, which she chose.

“Individual choice is what it comes down to and the makeup of the jury,” she said. “It will be very hard. They won’t have all of the emotional ties that we had. They won’t have the four-and-a-half months of testimony. They will be given a capsulated version.”

Because of the heavy interest in the trial, it will be difficult to find impartial jurors, Allen-Coogan believes.

“I think it’s going to be extremely difficult to seat a jury that is impartial,” she said. “However, I think it’s absolutely a possibility that Arias could receive the death penalty depending on what’s presented.”

The original jury couldn’t reach a unanimous decision on the death sentence because of mitigating factors, which under Arizona law include “any aspect of the defendant’s character, propensities or record and any of the circumstances of the offense,” according to another juror.

“Some individuals [on the jury] looked at some of the mitigating factors – for example, that Jodi had been abused – they felt that she had been abused by Travis and as a child. They didn’t feel she had the best family life,” Diane Schwartz said. “They felt that mitigating factor outweighed the aggravating factors. That was the biggest concern.”

The defense team for Arias introduced eight mitigating factors, including her age, troubled upbringing, and artistic talent.

Prosecutor Juan Martinez, on the other hand, argued that none of the factors mattered in the brutal murder case.

Arias was convicted of murdering her boyfriend Travis Alexander, who suffered nearly 30 knife wounds, and was shot in the forehead.

She claimed that she killed Alexander in self-defense, but prosecutors convinced the jury that the murder was premeditated.

If the new jury cannot make a unanimous decision, then judge Sherry Stephens will decide whether Arias should get life in prison without possibility of parole, or get life in prison with possibility of parole in 25 years.

      I agree. since when did being an artist mean that murder is understandable? Since when does being an artist become more valuable than a man’s life? The jury did convict her of first degree and they did go for unusual cruelty but to even suggest the slightest belief that she was abused by Travis or her parents when there was zero evidence and that being an artist means that she is above sentencing to death is mind blowing. I just think the jury was exhausted and 4 of them needed a reason any reason not to convict someone to death. But I wonder how those 4 would have voted had it been someone they loved?

Some saying Travis abused her is crazy…it’s seems you just suggest it, with no evidence and it flies.           It will be interesting to see, how they rearrange Jodie this time….what comes in or not. I think the juror is probably right, it’s going to be a condense version, of all they saw. I’m sure Jodie will be way different on the stand this time. I wish it was televised, that judge is lame.
          Jodie probably did want to blackmail Travis with the sex tape, we all know it was a set-up for something. Remember she said Travis told her to record it——-I don’t think that monster has uttered a true word her whole miserable life.

      OMG you know that sex tape will be used. Of course it will as it will be considered some twisted proof of her claim. I hope Juan is able to squash it but the defense team feels that it is relevant. What bugs me about it is 1. she provided the tape and 2. who knows how complete it is as she could easily remove what she did not want heard. With that in mind it is amazing that is was ever admissible. What is really shocking is all the garbage she admitted into court with wild claims about Travis that had no substance just her word. That is unacceptable. She thought she could destroy Travis in court with her lies and get out of Jail free. Wrong again. I so wish that this time around Juan would make sure the jury knew Travis better .. like we do. I wish that he would make sure they heard from more of his friends, about his charity work , his book, his philosophy in life. That would be my only critique on the last trial.

    Hope they bring up the fact that the photos in shower are of all the areas he stabbed and she had plenty of practice slashing tires. Also in interview of her Mom, she reports Jodi told her she didn’t even have any gas receipts from AZ when her mother asked her about the murder and if she was involved. She probably threw the camera so he would get out of the shower and it was dragged by her leg somehow taking photos. She complained how horrible her family was then used them as a reason to spare her.

    Assuming the new sentencing jury actually follows the law (this time) her goose should indeed be cooked. Followup will last around 12.5 years before Dr. Nick arrives at Perryville with his black bag, white coat and whoopee cushion to dispense some long over due justice.

    His background musical choice will be Eva Cassidy singing ‘People Get Ready’ but instead of crossing the river Jordan into the land of milk and honey Hodi will be crossing into the land of fire, brimstone and pitchforks. That’s her ‘final’ destination.

        Quite simply:

        She was convicted of premeditated murder with extreme cruelty which was proven by the state which had the entire burden of doing so under the AZ rules of evidence which apply to criminal trials. The prosecution must prove, and did prove, the existence of the aggravating circumstances beyond a reasonable doubt.

        To avoid a sentence of death in Arizona the aggravating factors have to be outweighed by mitigating factors, the burden of which has to be established by the defense.

        Anyone who watched this trial and came to the conclusion that these alleged mitigation factors:

        Arias’s age
        Arias has no prior criminal history
        Arias was a good friend
        Arias lacked support from family
        Arias suffered abuse & neglect as a child
        Arias tried to make the best of her life
        Arias tried to improve herself
        Arias is a talented artist

        …and the establishment by Arias of a recycling program, a book club and the sale of items to benefit ‘victims of domestic abuse’ trumps the many aggravators here is either unable to understand the law or incapable of rationale thought.

        Additionally, convicted murderer Arias through her own words and actions (i.e. victim, etc.) continues to not only insist that she is not guilty of 1st degree or 2 degree murder under the law and publicly calling herself a victim of domestic abuse by the pedophile Alexander is a deliberate slap in the face of both the Alexander family and the state.

    Anyways, justice for Travis needs to be done. Give her a final verdict and get her off the news. Prolonging this into 2015 and beyond just creates bad feelings for everyone involved, notably the family of Travis Alexander.

            He is a rescue and they told me he doesn’t like dogs. My buddy stopped by with dopey and had to use the bathroom. Go ahead and he and dopey go up stairs. I went just to be safe. MONSTA took one look at dopey his tail went from a pencil to a cucumber and NO HISSY FIT but a scream and he launched himself from the top of the sofa and did his best imitation of a lion on a cape buffalo’s back. Dopey didn’t know whether to p or go blind. I grabbed the cat and put him in the bedroom. My buddy told me that Dopey learned to respect cats after that.
            Part 2 About 5 months later the same scenario and dopey goes up stairs takes on look around and runs outside with that “What are you doing?? Trying to get me killed !!” looks. Not so dopey afterall.

            :)….that poor cat had a bad experience with a dog, poor dopey felt the brunt of it! Dogs learn quickly, they don’t want to be hassled either, if possible. My dog stood up once a dober pincher, I had a heart attack almost, had to get him out of the dogs mouth…he was half his size, he learnt his lesson from that one. I Had to rush him to the animal hospital. Maybe cats are easier to have :)

            Nurmi is impatiently awaiting delivery of his customized red, with flames, Barca Lounger which is said to include a trailer hitch on the back to hook-up his fridge, pantry and cooking facilities and a hitch on the front to hook-up to Willmot just in case he overloads the 20 HP drive mechanism and she has to pull him again. If you think a mule can kick just watch the foot stomping performance Willmot puts on when Nurmi calls her ‘second-chair’ and hooks her up to his Barca Lounger!

      Without the death penalty she will be in the general population. Some have said if this happens some other inmate will do her. My fear is that she will kill again. I think she has enjoyed many aspects of this drawn out drama. Taking the overkill into consideration she (pun intended) used to kill Travis, I think it quite possible she enjoyed that also. She isn’t legally innocent because of insanity because she knew exactly what she was doing. But she is insane.

Found out the only “mother figure” that I had (a woman my uncle had been dating) was a total liar and basically created the situation that ended up killing my uncle in what now looks like a suicide. :( I found his journal. She was cheating on him and he found out. Last entry was “I’m done living this life.” He got drunk and stoned and crashed his motorcycle the next day and died at age 47 on his birthday. Very sad. She completely covered it all up. All lies for years. He died in late 2010. Say hi to people for me okay? I am sober, just upset. Had to go see her and get some things back. Tell Blue please. :)

        Though I share Chiron’s sense that if she were in the GP she would pose a greater danger to the other inmates than they would to her .. I kind of like the idea of her being in the GP. She may have won over Travis’ common good sense, but she didn’t win over his friends and family. She can only be convincing one-on-one, the trial proved that. She IS insane but she knew exactly what she was doing the day she killed Travis. If she ends up in the GP, I think she won’t last much longer than Dahmer did. If even that long.

    /that is just the point there is no evidence. She has publicly stated that Travis helped her , treated her good and was the most wonderful person she had ever known and that her childhood was idyllic. But then the story changes and the fog sets in, no it wasn’t ninjas after all, but Jodi herself who murdered him and she does it over and over again in court to save her own behind. .I hope and pray that the parts of her public interviews claiming how perfect Travis was and her childhood are made available in this court trial. Which is it a good upbringing or suddenly an abused one? Oh my bad, with Jodi History changes daily like the tides in the ocean.

    If there are demons, she surly on their list…one soulless creature she is. IMHO she would kill again, its in her blood now. She even bought a gun and had knives in her trunk, when the cops arrested her.
    Anyone who could do that, was on a huge power trip…she’s completely devoid of a conscience or heart. How she was able to slit his throat standing over him, Travis HELPLESS on the floor, is beyond evil. Either way she’ll die in prison or be executed…. that’s more compassion then Travis received.

    I’m kinda hoping the fact the new jury will have an capsule version of the first trial will make is so they CAN decide on a punishment suitable for the convicted murderer. The CM won’t have a chance to work her wiles on the new jury. Hopefully not enough time for the new jury to develop and emotional attachment to the murderer. I’m hoping that’ll be enough to either give her the DP or LWOP.

    It might take time to find a new jury but I think one can be found without having to move the venue. It’s been over a year since this all began so a few more months isn’t surprising. Frustrating and irritating as all heck but not surprising.

          I checked out the HP clicks at quantcast yesterday and it seems their numbers are down by a third of what they were averaging before they demanded a facebook account to post last December.

            It’s so boring at HP now. While I wasn’t in favor of trolls….I didn’t really see that they were much of a problem as HP made it out to be.

            Yes, I assumed Arianna made a deal with FB to sell them the people who commented on HP for $$. In addition, now that their traffic is down, conversations/comments seem lower in numbers so…there’s not much to moderate either.

    I’m thankful that, unlike Huff Puff, Epoch doesn’t splash pictures of Hodi all over their articles. Pics of her hands around her late prey’s neck were especially distasteful. They also do not promoter her from server to photographer like HP does.

    The reality is after years of taking orders and bringing out food she was in reality just one step up from strangling chickens for the Colonel.

        Even the Colonel had trouble selling their remains as original recipe chicken strips.
