Jodi Arias: Next Part of Trial Could End in Arias Getting Death Sentence

Jodi Arias was convicted of murdering her one-time boyfriend Travis Alexander, but the sentencing phase ended with the jury failing to reach a unanimous decision about whether Arias should go to jail for life or get the death penalty.

Prosecutors had the option of taking the death penalty off the table, meaning Arias could have spent her life in prison but also could have been eligible for release in 25 years, depending on the judge’s decision.

But prosecutors didn’t want that, and are pursuing another penalty phase, hoping the new jury can make a unanimous decision.

But CBS News legal analyst Rikki Klieman called that prospect unlikely

“The likelihood is that a jury is not going to come to a unanimous death verdict because there are just too many factors that mitigate in favor of a life verdict for someone like Jodi Arias, who is clearly quite disturbed,” Klieman said.

The mitigating circumstances can include “any aspect” of the defendant’s character or record. Eight of these circumstances were raised by the defense in the first sentencing phase, including her age, troubled upbringing, and creative talent.

Arias at one point asked the jury to sentence her to death but later said that she “lacked perspective.” She told the jury in May that “Either way, I’m going to spend the rest of my life in prison, whether it will be shortened or not.”

She added: “I want everyone’s healing to begin, and I want everyone’s pain to end.”

The next phase of the trial is slated to begin on January 3.

            Thanks Gurl. I actually had emailed them twice in response to their previous articles about what happened to me at huffpo and how much I had relied on it as a community being newly deaf and then how they’d turned on me. Maybe they lost the emails, I dunno. I also emailed to request any new Arias threads since I had brought and will still bring other trial junkies here in the future. Not sure anyone at Epoch got them, but I did send them and the ones about huff were good ones. I don’t want them to make a story up after the fact, if they had wanted to use me and my story I’m sure they would have.

            You’re so right. I actually figured what would happen is that the DT would say they were SO BUSY with all the other concerns (questions at voir dire, trying to move the trial out of state, asking for permission to view juror social media accounts, etc.) that they still needed more time to look for people to stand up for Arias. They still could, you never know. That DT may never stop pulling rabbits out of their hat.

        I saw that article! That’s funny. I watched an episode of Lockup on msnbc once and it was all about the recipes they create. Wow. Some nasty stuff. Reminded me of when I was in the Marines in boot camp. You get really obsessed with food because you can’t dictate what you eat or when or what it is! We would just talk about shrimp, pies, Hot Tamales and cookies. Totally funny.

      – Age. She was what, 27-28 when she slaughtered him? Why is her age a factor? She was an adult, not a teenager, and certainly past the age of 25 when the brain is said to be fully developed. (And speaking of fully developed brains, we can’t forget that hers is right up there with Einstein’s…just ask her!).

      – Troubled upbringing. Oh yeah, her dad shoved her into a wall or coffee table or something, and her mom beat her with a wooden spoon. But wait, didn’t she tell Flores during interrogation that she had an “idyllic” childhood and a close, loving family? What to believe, what to believe…

      – Creative talent. Ha! If by “creative talent” they mean the ability to trace magazine pictures and then color them in, then yes, I suppose she does have creative talent. (cough)

      I guess I shouldn’t be too hard on the defense considering what they had to work with. It’s like trying to come up with nice things to say about Beelzebub.

    The first jury found mitigating circumstances to avoid the DP so it wouldn’t surprise me if someone (two, three or four) in the new jury found similar mitigating circumstances. All I can hope for is the convicted murderer gets LWOP. The DP is okay with me too.

      we all know that the head juror felt sorry for her because she is a young and somewhat attractive female (to him).

      If she was a fat unattractive female, they would have all found her worthy of the DP.

      Nothing about the murder merits “mitigating circumstances” other than her looks and age, which IMHO shouldn’t even be relevant.

        Hi Michael, I couldn’t agree with you more. Had the defendant also been several shades darker than she is, I believe she would have gotten the DP. The jury foreman left much to be desired and he seemed biased at the first sight of the defendant. I don’t know how he got away with it but that’s how it goes. I can’t help but shake my head some of the time.

            Takawalk, you’re so sweet. I’m okay with my phone. It actually works great but once in a while there’s a site that seems to always want to force me to use their mobile version only. My bank for example- I can never actually view it as desktop. Weird. It’s all good. I have learned to live with very little. When I lost my hearing I had three cars, a 25′ Boston whaler, a big house, a great job, savings, friends, and what I thought was a great life. The people I worked for, wait for it, fired me! Yeah. Small business. I guess they didnt believe at 36 I could be going deaf. So they fired me while I was on a disability leave. So morally obtuse. As a small business they got away with it, too. I then lost all medical and dental. That was in 2008. Since then I’ve sold the boat, emptied all 401ks, all savings, sold 2/3 cars, re-mortgaged the house and nearly have lost my mind trying to pay for everything. I’ve lost it all. Everything. And try getting a new job when you are newly deaf and don’t know ASL and can’t cope or communicate. Impossible. I have had 4 years of “we will let you know.” Yeah. I have a private college degree with honors but now that I’m deaf I’m useless. It’s sad how society treats the deaf. I had no idea.

            But, I made it. I’m hanging on somehow. I hope to actually get medical insurance thus year since now I don’t have to fight with anyone about my pre-existing condition.

            Who knows if that will work? I do make it though. I have learned to cut corners better than any NASCAR racer! That’s how I figured to use my phone when my computer broke. I cancelled the phone service to save $ and just use wifi. Plus I don’t have to buy any Norton anti-virus. I’m just glad for the technology !!!

            Any one of us at anytime could find ourselves in the same position no matter how secure we think we are. There are few if any exceptions to that. My thought is this. If the role were reversed, and you were Blue, Canuck, me or anyone else who values your humor and wit and wants you enabled to be our friend on here. Would you not pitch in a few bucks you can easily afford to make sure when my (your) phone breaks we won’t loose touch with you? I am kind of liking the idea. You know you have things to contribute here, someone might find themselves in need of comfort that you might be in a unique position to give. this is how connections between people are made and become real. give it some thought and don’t resist it too much. If nothing else find a contact that can help you send word if your device is disabled. Somebody you have known a long time. Maybe one of the meatballs. I think you should accept a spare device that is wi fi ready. I bet some of these folks have old ones that aren’t broke but just slower than they wanted to be. I have one, but it is seven years old lol. you can do better if you let people do what quite a few were talking about last night.

Sometimes when a politician gets voted into office they find it hard to keep up the image. You need to just be you. There will be bumps,highs and lows but i think you belong there.I hope you can bring in some more folks you know. But you have some known friends and some new ones in the HP refugee gypsies camp. You don’t seem the type that would take that lightly or to allow it to mean more than it can. But don’t assume it doesn’t have a very high value. It does, and you should get the most you can from it as you do what you do. There are many reasons folks have found a desire to come to your aid the only way they can, as for me it is simple. I like you, and if I only know you for a short time it is what it is. But it is something that has helped me smile and feel a part of something for a minute in time. I don’t think too many folks will see this post that shouldn’t, which is why I make it here. Tell the meatballs I said Hi. A few of them might recognize me. I enjoyed a few Tom Collins tonight, if anybody points this post out to me I will inform them I just kicked my evil (uh good)twin off the puter and he pushed the send button before I could stop him.

    The worst thing about this trial is knowing that if a man did this to even another man, the trial would already be over and he would be sitting on death row.

    It is 100% proven she premeditated the murder, tried to create an alibi for herself long before going to him, turned off her cell, bought gas cans, then, after the murder, tried to cover up the evidence of her being there.
    Then showed zero remorse for what she did, and is trying to make herself out to be the victim

    If anyone in this world deserves the DP, it is her.
    I dont care if she is put to death, I just want her to be on death row, so she cant have a somewhat productive life in prison, but that is what will happen.

    She will most likely get life w/o parole, and get to have somewhat of a decent life behind bars.

    Considering what she did and how she is behaving, she deserves nothing but a small cell as a home, 23 hrs a day, no TV, no paint by numbers “art”, no second hand twitter posts, no TV interviews, book deals, movie projects and certainly no “advice” from her on coping with her mental crap.
    Charles Mason been sitting in a cell for a very long time and Miss Stabby is worse than him, she deserves the same penalty, locked in a cell, no privileges and forgotten about.

    If she would have owned up to it and showed remorse, I would agree with life, but she did not and the way she is handling this, along with her twitter feed, she should be given no breaks and held completely accountable and put on death row.

        You must be psychic Jasmine! It’s 4am where I live and a team of people around the world are as we speak creating a timeline. We have recorded interviews and obtained screengrabs of records of the gross inconsistencies created by witnesses who just couldn’t keep their mouths shut as soon as the trial finished. All the material we need for an appeal and a new trial as asap.

I saw some other comments she made on other subjects, and I’m sad to say I agree with some of those, a mix bag with her….yet, she’s off the wall with the cold murderess JA case.

    It seems to me that no matter how the 2nd Penalty Phase goes, CMJA is going to have a boatload of appellate issues. Her entire trial was/is so convoluted. She has managed to muddy the waters so deeply between the interviews, the tweeting, the endless motions, and the sheet amount of time that has gone by, all making an unbiased jury fairly impossible. She truly knows how to “work the system” as proven just based on the fact that she remains in county jail rather than in Perryville, where she belongs having been CONVICTED of 1st Degree Premeditated MURDER!! It saddens me that I honestly do not believe that The Alexander Family will ever see justice served. True justice that is, which in no uncertain terms would be the Death Penalty. I honestly don’t believe any jury will agree to that 12-0. I predict that after a long, drawn out penalty phase retrial, the jury will deadlock, leaving sentencing up to Judge Stephens and death off the table. I would like to believe that Sherry would give her LWOP as opposed to LWP, but who knows? Regardless, The Alexander’s will spend countless years in Appeals Court as the murderess continues to attempt to avoid punishment by trying to have her original conviction overturned on appeal.

    Another refugee from Huffington Post here. I spent a fair amount of time posting on the ongoing Ariass’ Saga there but left in early November after I got tired of getting one in three posts landing on the cutting room floor as a result of inane over-moderation by people who
    apparently never read or understood their own site’s posting rules.

    No Facebook for me. I refuse to be a member of any club who would have me as a member.

            Since you are a fan of Greek mythology, I bet you are one of the few who, like me, found it ironic that Arias’ former cellmate, named “Cassandra,” told everyone that Arias would like to see Martinez dead and that no one believed her.

            Of course, spurned by Apollo, Cassandra ALWAYS told the truth and was never believed. She even warned the Greeks about the war. Ha ha. Even Woody Allen loved Cassandra.

            I believe it was Prometheus who stole fire giving it to man.

    Arias is due in court at 2:30 PST. What will happen? My guess- yet another delay.

    They have already done exactly what the defense team asked for last May-June, to continue the trial in January to have more time to look for a person to stand up for Arias. They asked for a continuance until 2014 and they got it, but in a sneakier way than if they had just been granted it.

    I have no doubt whatsoever that now they will say they have been “so busy” with all the other continuances regarding the jury sequestration requests, the jurisdiction requests, et al., that they will probably say AGAIN that they still have no witnesses to stand up for Arias and will beg for yet more time.

    Boo. And Stephens the foot-dragger will allow it.

      I believe the biggest reason the continuation of this trial has been delayed so many times since last June is an abundance of caution by the judge (Sherry Stephens). She is presiding over her first Capital case and is desperately (if inexpertly) hoping to avoid having the sentence, or any part of it, reversed on appeal in the course of the guaranteed subsequent appellate review.

      The cost to prosecute Ariass’, paid entirely by the citizens of Arizona, which officially should play no part in her actions/rulings, is probably doing so at least subconsciously in the back of the judge’s mind.

      At this point Ariass’ and her defense team have managed to delay by nine months her ultimate fate. In Ariass’ mind the more distance that she is able to put between her horrific crime and judgement day the better.

      I still believe that when a new jury ultimately hears the redo of the penalty phase Ariass’ will receive the death sentence she worked so hard to earn… if they in fact follow the law.

        I agree, it’s her first DP trial and I’m sure she’s being careful. I just poke at her and the DT, even though the DT is also just doing their job (and doing it really well) by getting delay after delay for their client. She’s getting a really great defense if you ask me. There’s nothing they haven’t tried yet. Pretty much.
