Jodi Arias Trial to Stay in Phoenix; Hearing in January


Jodi Arias, the Arizona woman convicted of killing her boyfriend Travis Alexander five years ago, will have her sentencing phase retrial in Phoenix.

A judge denied a second motion from her defense attorneys last week, reported The Associated Press. The attorneys sought to move the trial due to intense media scrutiny.

A pre-trial hearing will take place on Jan. 3 ahead of the trial, which starts in mid-February, Alexander’s brother, Steven, wrote on a Facebook page.

“Letting everybody know, the trial isn’t due to start until mid February. We believe this is a tactic to try and get us to throw in the towel. We will not! I say again it won’t happen. Our family will come together and see it through until it is finished,” he wrote.

He added: “There is a monster that haunts us, but once the correct sentence is given, it’s her who will be haunted until the most the most humane punishment comes to her. Nothing compared to the sentence she gave to a good man. Anyhow, the entire Alexander family thanks all of you. Thank you for having our backs.”

The sentencing trial date has not been specifically set. Prosecutors are trying to seek the death penalty.

In the first sentencing attempt, jurors failed to agree on her sentence, leading to the new trial.

Arias, 33, said she killed Alexander in his suburban home in 2008, but she said it was in self-defense. Alexander was stabbed more than 30 times, his throat was slit, and he was shot in the head.

Prosecutors argued that Arias killed him in a jealous rage.

A month ago, a report said that Cassandra Collins, a woman who shared a cell with Arias, claimed Arias wanted to kill Maricopa County Attorney Juan Martinez if she got the death penalty. Her cellmate also said Arias had an odd infatuation with Martinez.

“She’s dangerous, very dangerous,” Collins told KSAZ-TV in late November. “She’s out of her freaking mind.”

Collins said she was speaking out because she feels Martinez is in danger.

“She asked me questions like, ‘Why doesn’t Juan Martinez love me?’” Collins said. “And I’m like, ‘Love you? He’s your prosecutor. He’s there to prosecute you for a crime.’”

    Finally! The penalty phase is long overdue, thanks to her defense team’s seemingly endless stall tactics just so they could find some credible (ahem) mitigating witnesses. They’ve had five years to do that and came up empty handed…imagine that!

Thanks for the Link and shame on HP for not realizing how loyal we all were (to them) while they were building their Brand! There were many ways they could have chosen to go but going with Facebook was a mistake.

            Too bad others at HP who left aren’t aware of this site. I had never heard of it. IF many who left and not just Trial followers came here it could put this site on the map! lol

            Tim’s Tech page where people were talking about leaving HP and also trying to gather a Plan to go to HP hoping to talk some sense into them was taken down, when HP realized 99.9% of comments were angry, making derogatory comments about Arianna and leaving in droves! HP didn’t want the anyone to see how negative the consequences were by their ridiculous Facebook rule.

            Well! What’s strange too is that the huffgestapo seems to be getting down in everyone lately. I have a friend who just told me she was making comments as per usual at huffpo on a site about an issue in New Jersey and they stopped posting her comments. She said she got upset and started posting questions asking why aren’t you all posting anymore? She said they banned her, removed her profile and all her old comments, just like that. It seems huffpo has zero tolerance anymore. How sad for them.

        Also Travis’s letters that weren’t admitted (they didn’t even elaborate on who found them forged, what method was used to prove it), the very same where Travis confesses to being a pedophile, and Matt Maccarthy was willing to vouch for their authenticity (oh, wait, Martinez threatened him with prosecution if he testified)
        And how about that report by our illustrious Dr Horn where he stated that the brain was intact (sure, later he recanted, but why do it on the stand when he had 5 years to do it???)

    Ask yourself – Maricopa being a predominantly Hispanic community, why were all the jurors white? None of them were Hispanic or African American!
    Is Martinez racist? Or did he want to leverage the white population’s bias against Hispanics to secure an easy win? (sinse Jodi is of Hispanic descent)

      People don’t like questioning authority, they believe that prosecutors are always right, “on the side of the law”, but that is not always the case, and sometimes prosecutors cross the line, bend the law to their advantage. Prosecutors too have a stake in it – the more cases they win, the more money they get (promotions, career growth, etc.)
      I’m raising these questions because I don’t think Martinez played fair and I’m trying to bring public attention to it.
      From the get-go, he changed his theory of the crime, by stipulating that Travis was stabbed first. He did it to get in an aggravation factor, with an eye to convincing the jury to give her the death penalty. In Dr Horn’s report it says in black and white that the dura matter was intact and that the brain was not injured. Later Dr Horn suspiciously “recanted” and said that he had “made a mistake”. But it says that the brain is intact in THREE places in his medical report. One can hardly make the same mistake in three places, and MISS it after a few revisions. I find it hard to believe.

      These are excerpts from Dr Horn’s report that corroborate my suspicions regarding whether Travis’ brain was intact or not:

      Except for the fact that he’s blaming Juan Martinez for it. Both sides have a say as to who gets selected or disqualified as a juror. Furthermore, unless he can provide a valid source to back his claims that Martinez “had all Hispanic and African American jurors disqualified” he’s merely spewing nonsense to push his agenda.

        Can you point out at least ONE Hispanic or African-American juror? I sure can’t. Because ALL of them were white. I heard that Martinez repeatedly struck down every propective Hispanic juror. I’m not making this up, look it up. Martinez insists that he struck them down for other reasons, but I find it suspicious,
        Also, Martinez withheld crucial evidence from the defence: “Initially the prosecution told the defense attorneys that there were no available text messages sent or received by Alexander and then was ordered to turn over several hundred.”
        How do you explain that? Why would Martinez do such a thing if he was on the “up and up”? Why resort to such dirty tricks, other than to hamper the defence, to throw the monkey wrench into the works to thwart the defence team’s efforts?

            Here’s a quote from Wikipedia:
            “According to the 2005-2007 American Community Survey ….Hispanics and Latinos made up 29.0% of Arizona’s population”

            It’s statistically impossible (highly improbable) that of the twelve RANDOMLY selected people none were Hispanic! At least 2-3 should have been Hispanic! In the original jury pool (of around 400) there were Hispanics and they were methodically culled out by Martinez. Even the alternate jurors (the ones that took over after the three jurors that were dismissed) were whites!

            Another quote from Wikipedia:
            “During jury selection on December 20, Arias’ defense attorneys argued that the prosecution was “systematically excluding” women and African-Americans;”
            Sure the judge ruled against the defence, the judge showed her bias in ruling against almost all defence motions, and she didn’t have the acumen to sequester the jury and ban the media from the courtroom, thereby letting the trial turn into a public spectacle/show and putting defence witnesses in grave danger (some defence witnesses bowed out after they got death threats).

    Voir dire is used to choose the sitting jury. The jury pool is selected by each county and these people are sent a notice to come to court to be selected or not selected for jury duty.

    NO prosecutor or defense attorney is involved in choosing those who show up for jury duty. It’s now done by computer.

    There is no way that Juan could select only those jurors who were white!

    Suggesting that scenario is utter nonsense, ignorant of the legal process and disregards Juan’s legal responsibility as the Prosecutor as well as; making Nurmi & Jennifer look like they was in cahoots with this ‘all white’ plan as well.

    Jodi’s fans are fond of conspiracy theories because they can’t handle The Truth.

      You’re absolutely correct – the jury pool (approximately 400 people) is selected at random.
      But during voir dire they need to narrow the pool down to 12 jurors and 6 alternates. Martinez and Nurmi get to STRIKE certain jurors. And Martinez systematically struck Hispanics, and African Americans
      He gave various reasons for that, but it all came down to him wanting an all-white jury (and whites are mostly prejudiced against Hispanics).

        Both prosecution and defense can challenge prospective jurors equally. If Arizona jury selection process is similar to California, each are allowed a specific number of rejections with and without cause.

        It is the job of each to select those jurors who will be sympathetic to their case. No mystery, no conspiracy.

    Good points, Jerry. From what I gather, Arizona allows each side 10 peremtory
    challenges (strikes without cause) in death penalty cases. Although this
    particular article doesn’t indicate how many “challenges for cause” are allowed,
    other pages I skimmed suggest that it’s an unlimited number as long as the party
    making the challenge can offer a specific reason or grounds for the strike. Even
    then, their request to strike for cause can be denied, in which case they can still
    use one of their remaining peremtory challenges (if they have any left) to disqualify a juror.
